These Terms of Service govern the services provided by Canadian Web Creations. By engaging our services, you agree to the terms outlined below.
Canadian Web Creations provides website design, web hosting and management, search engine optimization, and related digital services. Specific service details, pricing, and deliverables may also be outlined in project proposals or service agreements.
If any conflict exists between a proposal and these Terms, the proposal will apply only to the specific service described.
Canadian Web Creations reserves the right to update these Terms at any time. Updated terms will be published on our website.
1. Services Overview
Canadian Web Creations provides services including but not limited to:
- Website design and development
- Website hosting and management
- Search Engine Optimization (SEO)
- Website updates and ongoing support
Services are performed using industry best practices and reasonable professional care.
2. Web Hosting and Website Management
Clients receiving hosting or website management services are entitled to reasonable website updates as part of their plan.
Reasonable changes typically include:
- Content updates
- Image replacements
- Minor layout adjustments
- Small feature tweaks or bug fixes
Requests that fall outside normal maintenance, such as major design changes, new functionality, or structural modifications, may be quoted as a separate project.
If the volume of requested changes consistently exceeds what is reasonable for a client’s plan, Canadian Web Creations reserves the right to recommend adjusting the client’s monthly or annual rate to better reflect the level of support required.
3. Website Design Projects
Most new website projects are completed within approximately one month.
Projects follow the standard payment structure:
- 50 percent deposit due at the start of the project
- 50 percent due upon completion before launch
Project timelines depend heavily on client communication. Delays in receiving required content, images, approvals, or feedback may extend the completion timeline.
Reasonable revisions are included within the agreed scope of the project. Significant design changes or additional features requested after approval may result in additional charges.
Upon full payment, the client owns the final website content and custom design created specifically for their project.
Canadian Web Creations retains ownership of any internal tools, frameworks, templates, or development systems used to create the website.
4. Search Engine Optimization (SEO)
SEO is an ongoing process and results take time to develop.
It is normal for the first three to four months to show little visible change in rankings or traffic. Search engines require time to crawl, evaluate, and re-index the changes made to a website.
SEO performance is influenced by many factors outside the control of Canadian Web Creations, including search engine algorithm updates, competition, and market conditions. Specific rankings or traffic increases cannot be guaranteed.
Clients may scale their SEO plan up or down as desired. Lower service levels generally result in slower progress due to reduced scope of work.
5. Payments and Billing
Payment terms will be outlined in invoices or project proposals.
Recurring services such as hosting and SEO are billed monthly or annually in advance.
Invoices are expected to be paid according to the terms listed on the invoice. Accounts that remain unpaid for more than 30 days may have services suspended until payment is received.
All fees are exclusive of applicable taxes, including HST where required.
6. Refunds and Cancellations
All payments made to Canadian Web Creations are non refundable.
For hosting and management services, any prepaid period is considered the cost associated with service allocation, administrative processing, migration support, and account shutdown.
Clients wishing to cancel recurring services must notify Canadian Web Creations prior to their next billing date. Cancellation requests received after an invoice has been issued will apply to the following billing cycle.
Website design deposits are non refundable. If a project is cancelled after work has begun, the deposit will be retained and additional work completed to date may be invoiced.
7. Domain Names and Website Ownership
Domain names registered on behalf of a client remain the property of the client once all associated invoices have been paid.
Canadian Web Creations may maintain administrative control of domain or hosting systems while services remain active.
Upon termination of services, reasonable cooperation will be provided to assist with website or domain transfers. Canadian Web Creations is not responsible for compatibility issues with third party hosting environments.
8. Client Responsibilities
Clients agree to provide accurate content and respond to requests for information in a timely manner.
Clients are responsible for ensuring that all materials provided to Canadian Web Creations, including images, text, trademarks, and logos, do not infringe on third party rights.
Websites may not be used to host illegal, malicious, or abusive content. Canadian Web Creations reserves the right to suspend services if such activity is discovered.
9. Suspension of Services
Canadian Web Creations reserves the right to suspend hosting, management, or other services for accounts that remain unpaid for more than 30 days.
Services may also be suspended if a website is found to be hosting malicious software, engaging in illegal activity, or violating reasonable standards of use.
10. Limitation of Liability
Canadian Web Creations provides services on an as available basis using reasonable professional care.
Canadian Web Creations shall not be liable for indirect or consequential damages, including loss of revenue, business interruption, or loss of data.
Total liability for any claim shall not exceed the amount paid by the client to Canadian Web Creations during the previous twelve months.
Canadian Web Creations is not responsible for issues caused by third party providers, including hosting infrastructure, domain registrars, payment processors, or search engine platforms.
11. Indemnification
Clients agree to indemnify and hold Canadian Web Creations harmless from any claims, damages, or legal costs resulting from content provided by the client or from the client’s use of the services provided.
12. Force Majeure
Canadian Web Creations shall not be held responsible for delays or service interruptions caused by circumstances beyond reasonable control, including but not limited to internet outages, server failures, cyber attacks, natural disasters, or infrastructure failures.
13. Governing Law
These Terms of Service are governed by the laws of the Province of Ontario and the federal laws of Canada.
14. Amendments
Canadian Web Creations reserves the right to update these Terms of Service at any time. Updated terms will take effect upon publication on the Canadian Web Creations website.
